Refunds & Returns ~~ Patio Lights, Seasonal Items, etc.:  
All Sales are considered final unless a problem occurs.
 We will accept returns or exchanges according to the following conditions: 

On all Online ordering:   My return policy is simple.

  • All postage / handling Fess are non refundable.
  •  I will accept returns for Exchange Only within 30 days towards like items.  
  •  If a light string fails - The Original Light suppliers will send you FREE replacements for damaged or non functioning lights.  
    This prevents loss of unnecessary shipping/ handling fees.
  • Lights that have been used or are in anyway damaged, do not qualify for a refund/ exchange, and one will not be issued. 
  • Lights that are returned for ill function, are accepted for Exchange Only.
  • Any Light returned for any other reason than they are broken or not functioning are subject to a 25% restocking fee.
  • We no longer issue Cash Refund on items returned that are not damaged. 

    We will issue Web Site Product Credit that can be used for other purchases. 
     A Credit Certificate (less the 25% restocking fee) will be emailed.  All shipping and handling are non refundable.
  • We will not issue Cash Refund for Gift Certificates.  We will accept Gift Certificates, redeemable toward most Web Site listed items.
  • Seasonal items are special order.  We will issue Cash Refund for Season Items that are found to be defective.  Defective Items need to be returned to receive refund.  Shipping fees are non refundable.
    We will issue website credit Only (less 25% restocking fee) for seasonal items that are returned because of Change of Heart.  All shipping and handling are non refundable.
  • We are not responsible for product changes made by the manufacturer / distributor.  Our listings are based on their information.  If a product has been enlarged or downsized because of production, it is not our fault, and we can not accept it for return or refund.
    On special circumstances, we can issue a website credit that can be applied towards future purchase.
  • Products shipped, then found to be discontinued, can not be returned for refund.  On special circumstances, we can issue a website credit for future purchases
  • EBAY change of heart.  Lights purchased on Ebay are non returnable for refund of any kind.  We will authorize Exchange for a similar / like value item at no extra charge.
  • Large quantities (any order over one set per item) are considered special order and a restocking charge of 25% is applied and deducted from the issued Credit.  A Web Site Credit will be issued for further purchases.
  • Any order over 1 (one) set per item placed by customer for their review or sample, may be returned, but is subject to a 25% restocking charge. This charge will be deducted from the Credit.  All Shipping and Handling is non refundable.

Ebay items may be returned for exchange ONLY
USPS shipping / handling fees are non refundable. 
 No cash refunds are issued, 
only Web Site Product Credit that can be used toward purchases of other items.

Damaged patio lights must be replaced by the original supplier according to their terms and conditions.. 

We will reship whatever item  that arrives beyond repair, replacement cost free, but the customer must pick up the shipping charges. We will refund if the customer is dissatisfied.  All USPS Shipping/ Handling is non refundable.  We do recommend that customers notify us immediately, so that we may discuss options. 

Ebay items may be exchanged or returned. Refunds for Ebay items are accepted and subject to a 25% restocking fee (to cover all Ebay incurred fees and expenses.)  USPS shipping is non refundable.  No cash refunds are issued, only Web Site Product Credit that can be used toward purchases of other items.


Established since the Spring of 1978, South Creek Nursery has strove to offer many traditional favorites, as well as new and exciting cultivars. All our perennials are grown outside in 4" or 5" containers, where they thrive and overwinter until shipment the following Spring. We grow in a soilless mixture, with additional time release fertilizers. Our plants are a year old or more at point of sale, and will flower in your garden as seasonally permitted.

CATALOGS: We no longer offer catalogs. Plants listed on the website are current.  We are working on a PDF file to easily email the ever changing list.

QUANTITIES: We encourage a $5.00 minimum order. Wholesale prices are offered to ALL internet customers.

PLANTMANSHIP AND YOUR SELECTION: Each year we offer new and exciting varieties, and identify them as New & Awesome. Feel Free to ask us to book a colorful selection for you. We will FAX an availability list upon request.

SPECIAL REQUEST: rabbithat.gif (4061 bytes) Items so designated are custom.  These items have to be acquired from other vendors and specially grown for our internet wholesale customers.  As with any Special Request Item.. we are dealing with another grower and their schedule to produce the item.  We are not responsible for their growing deficiencies.  It is our hope that This Unique set of vendors can provide the requested items on a timely basis. 

When these Vendors are unable to fulfill our need, we will consult with you as how best to address this  issued accordingly.  Substitutions may be suggested, or requests/orders held over for another season.

TERMS AND CONDITIONS OF SALE: - We no longer offer accounts.  All transactions are considered CASH  and must  must be prepaid by a certified bank check , Postal money order, or credit card (visa, master card, discover) or PayPal.  Credit card preferred.  We accept American Express via PayPal invoice.
We do not accept Personal Checks of an sort.

Shortages, complaints, or returns must be reported within 24 hours of receipt of order. Remarks later than 2 working days are not subject to credit review. Orders are accepted on our good faith basis to supply material that is salable. Tree peonies are shipped bareroot.  However we will not be held responsible for unforeseen crop failures, over wintering losses or shipment disaster ( USPS).
We are also not responsible for plant identity errors from other vendors.  We trust that they are true in their plant labeling and propagation efforts. If a problem occurs.. the most we can do is pass the complaint along.
We reserve the right from time to time and with your consent to impose special terms and conditions of sale.  All shipping disasters caused by the carrier should be addressed to the USPS, or other carrier, and a form 1000 filed for refund.

Refunds & Returns ~~ Plants: We do not provide CASH REFUNDS.  We recommend that customers notify us immediately. We suggest that all questionable plant material be planted on arrival, and if after a 150 days grace period, the plants fail to leaf out ---do not improve or regenerate, a free replacement can be requested --however the customer must pick up the cost of reshipping.
We will not replace plants lost due to weather damage (such as drought or flood), pest destruction, or growing conditions beyond our control. We do not refund with money, just in more plants, unless the specified plant is out of stock or discontinued.  Plant returns are discouraged.

Once bare root plants are shipped, received  & planted - and become exposed to soil diseases / pest contamination, they can not be returned for Cash Refund at any time.  USDA prohibits transport between states of any uninspected plant - peony for return/resale. 

Plants won and shipped are guarantee to be correct to the listing, alive when shipped,
and USDA inspected free from pests.  Any peony planted over 10 days, can not be returned for refund,

PLANT LABELING: Each plant is provided with a information tag (picture when available).

DELIVERY: We will deliver to your location/site all plants that are saleable within our delivery area at no additional freight. We will ship USPS freight billed when usual delivery is impractical. We reserve the right to bill a restocking charge equivalent to 25% of the total order on inexcusable refused shipments. To insure the best guaranteed delivery during summer months.. We Prefer  Priority USPS Mail for all customers, except in Canada.   As an added benefit, all packages are given a USPS Delivery Confirmation at an additonal charge of .35 per confirmation. Shipping, not a joke!

SHIPPING SCHEDULE: All LIVE Tree Peony  orders are shipped from April 30 until December 1; We will extend this shipping schedule depending on weather conditions and destination.

Tree peonies are shipped in October when available.

Non plant items are shipped upon availability..

A required $3.99 handling charge is applied on all orders.  

Handling charges are not applied on Ebay Auctions.

Combined plant & non plant shipments handling fee will not exceed a maximum of $3.99.

The exact USPS rate is calculated on each order dependent on package's total weight, destination zip code, and speed of delivery.  These charges varying according to the service. 

The $3.99 handling fee will not be applied backorder items. 

SALES TAX: We must have your properly executed New York Sales Tax Exemption Certificate/number on file or we will charge tax on all purchases delivered within New York State. Customers ordering/receiving from outside New York State are not subject to sales tax.

CUSTOM GROWING: We try to maintain a large variety of plant materials to meet your landscape/garden center needs. We invite you to bid out perennial jobs with us in mind. With the right selection, pricing, and growing time, we can help meet your job demands. We are the source for the individual home/gardener-landscape specialist.
